Are you eligible? Learn about the Obamacare 2026 requirements

Meeting the requirements for Obamacare 2026 is the first step toward obtaining affordable health insurance in the United States. However, not all residents are eligible for subsidies through the Affordable Care Act (ACA). At Cima Insurance, we’ve found that confusion about eligibility often holds many families back, so today we’re breaking down who doesn’t qualify and why.

Below are the factors that could prevent you from enrolling in the Marketplace:

1. Immigration Status

Requirements for Obamacare 2026

To access Obamacare, you must have legal status in the U.S. This includes citizens, permanent residents (Green Card holders), asylees, refugees, and people with valid work visas. Unfortunately, people without legal immigration status are not eligible for marketplace plans.

2. The Income Factor: Medicaid or Obamacare?

There is a lower income threshold. If your annual earnings are very low, you may qualify for Medicaid, which is administered separately. Obamacare is designed for those who earn enough not to qualify for Medicaid but need help paying their premium.

3. Coverage through the Employer

If your employer offers health insurance that meets minimum coverage standards and is considered “affordable” under the ACA, you generally will not be eligible to receive subsidies in the Marketplace.

4. Specific Visa Types

Not all visas grant eligibility. For example, visitors with a tourist visa (B1/B2) do not qualify for Obamacare, as it is considered a temporary stay and not permanent legal or tax residency.

5. Other Important Exclusions

  • State Residency: You must live in the state where you are applying for coverage.
  • Public Institutions: People who are in prison or similar institutions are not eligible.

Frequently Asked Questions about the program

Can I apply for Obamacare if I have a student visa?

Yes, most student visas (F, J, M) are considered “legal presence” and allow you to apply to the Market.

What happens if my income changes during the year?

It is vital to report changes in income to your insurance agent, as this directly affects the amount of your benefit and prevents debts with the IRS.

If I don’t qualify for Obamacare, will I be left without insurance?

Not necessarily. There are private plans and other off-market options that we at Cima Insurance can explore with you.
